Product and Privacy Counsel

Brex is seeking a Product and Privacy Counsel to join our Legal team in New York. You will provide legal guidance on privacy and product initiatives, advise on GDPR/CCPA/CPRA, draft and negotiate data processing agreements, and help embed privacy-by-design across Brex's products.

Responsibilities

• Provide legal guidance on privacy, data protection, and product features across Brex's platforms.
• Draft and negotiate data processing agreements, vendor contracts, and privacy notices.
• Advise on GDPR, CCPA/CPRA, and international data protection laws; manage cross-border data transfers (SCCs/IDTA).
• Collaborate with Product, Engineering, Security, and Compliance teams to embed privacy-by-design into product development.
• Respond to data subject access requests and coordinate incident response for data breaches.
• Manage regulatory inquiries and interactions with privacy regulators; support audits and risk assessments.
• Develop and deliver privacy training for employees.

Requirements

• 6+ years of relevant legal experience in technology/privacy, ideally in fintech or software.
• Active U.S. state bar admission.
• Deep knowledge of privacy laws (GDPR, CCPA/CPRA, etc.), data governance, and information security concepts.
• Experience drafting data processing agreements and cross-border data transfer mechanisms (SCCs/IDTA).
• Excellent communication, negotiation, and problem-solving skills; ability to work cross-functionally in a fast-paced environment.
• Strong business judgment and ability to balance legal risk with product goals.
